Smart Planning has successfully won an appeal against the refusal of planning permission by the City of Westminster Council in London for lower ground floor rear extensions, a ground floor rear extension, plus the installation of a bin store in the front garden.
The appointed Planning Inspector agreed with our submissions regarding design and amenity. He said “The dwelling is located within the Bayswater Conservation Area, but I am satisfied that the proposal, given its acceptable design and sheltered location, would have a neutral effect on the Conservation Area, whose character and appearance would thus be preserved”.
The Inspector also concludes “that the scheme, taking account of the previously approved scheme, would have no material impact on the living conditions of neighbouring residents. Accordingly no conflict arises with those provisions of policy ENV13 of the Council’s Unitary Development Plan designed to safeguard and protect residential amenity”.
The appeal was subsequently allowed.
