Smart Planning has successful appealed the decision of the London Borough of Barking and Dagenham to refuse a lawful development certificate for a site in Barking.

The proposal in question involved the erection of a 75.5 square metre outbuilding to be used as a swimming pool and a gym. It would also feature a steam room and sauna.

The Inspector agreed that despite the large footprint of the proposed building, it was “intrinsically incidental to the enjoyment of the dwellinghouse” and “its scale and siting would not be excessive”.

Inspector J Whitfield was also satisfied that “the health and fitness purposes of the building put forward are ordinary activities one may expect to find taking place in a home”.

The appeal was therefore allowed, much to the delight of the client.
